IMARIKA TERMS AND CONDITIONS OF LOANS – Imarika Empowerment Loans

These Terms and Conditions govern the opening and use of a Loan Account with Aventus Technology Limited (“Imarika Empowerment Loans”).

WHEREAS

This Agreement is a financial service and an end-user license agreement between you (“End-user” or “you” or “Borrower”) and Aventus Technology Limited, a company incorporated under the laws of the Republic of Kenya with registration number PVT-GYUKVZZ (hereinafter referred to as the “Lender”, “us”, “we”, or “Imarika”).

1. Eligibility

You must be a resident of Kenya, aged between 18 and 62, with a valid national ID and a verifiable source of income to apply for loans.

2. Loan Application and Approval

All loans are subject to approval. Approval depends on your creditworthiness, repayment history, and our internal scoring systems.

3. Interest and Fees

Loan interest rates and service fees are disclosed prior to acceptance. You must review all charges before confirming any loan offer.

4. Repayment Terms

Loans must be repaid by the agreed date via M-Pesa or supported payment channels. Late payments may attract penalties.

5. Account Use

You agree to provide truthful and complete information. Misrepresentation may lead to disqualification and legal consequences.

6. Privacy and Data

Your personal data will be collected and processed in line with our Privacy Policy and Kenyan data protection laws.

7. Termination

We may suspend or terminate your access to services if you breach these terms or misuse the platform.

8. Limitation of Liability

We are not responsible for indirect or consequential losses. Our total liability is limited to the amount of your last loan.

9. Governing Law

This agreement is governed by the laws of Kenya. Any disputes shall be handled in Kenyan courts.
